1. Introduction
geOps offers various map-based services under different toplevel domains (geops.de, mapmatters.org etc). These terms and conditions apply to the services operated under all of geOps domains.
There is no claim on the provision of services as a whole or an individual service. Before you use these services, please read the terms carefully. The use of the services requires that you accept these terms and conditions.
All currently available services are provided free of charge. Special conditions of use apply to free-based services.
2. Registration
For the use of some services, you may need an account. To register for an account, you will need a username, an email address and a password. Please make sure to provide correct information so we can contact you via email in a particular case. You must ensure that the password and account are not accessible to any third party. You carry the responsibility for all activities that occur under your password or account. You must notify geOps immediately of any unauthorized use of your password or account as well as of any other violations of safety regulations.
3. Data protection and copyright
geOps is aware that sensitive handling of all personal information forwarded to geOps is extremely important to our users. geOps complies with all relevant statutory provisions regarding data protection (German data protection laws, European data protection guidelines, and any other applicable data protection law). Your information will not be disclosed to third parties, it will be used only for the functionality of our services.
4. Use of services
You are not authorized to use the services in an improper manner, to intervene in the service or to access the services by means other than through the interfaces provided by geOps.
If you violate these terms and conditions, additional conditions or other regulations that apply to the use of the service, geOps may exclude you from using our services.
You are responsible for compliance with copyright and other rights, if you combine your own content with the services offered by geOps. geOps is entitled to exclude you from use of services if you fail to use the services of copyright or other rights.
5. Content of services
geOps is entitled to review your content to its illegality or to the violation of rules of conduct of the service. geOps can also remove content, if the contents are illegal or if they violate the code of conduct for the respective service. geOps is not responsible for your supplementary content nor for the content of third parties.
6. Content from third parties
The maps provided by geOps services include information and additional third party content. The use of third party data may be subject to additional license terms. Information and links to specific license terms are displayed in the context of the information and must be respected by you.
7. Rights of geOps
geOps and its licensors retain all copyrights and other rights to the services. You are not entitled to remove, conceal or alter legal notices (such as copyright or trademark notice) that appear in the service.
8. Modification or termination of services
geOps is not required to provide free services. In return, you may stop using the services at any time.
The services of geOps change over time, in this way, individual functions or features may be added or removed. Similarly, services may be discontinued temporarily or permanently, i.e. for technical or legal reasons. Insofar as possible, geOps will inform you in advance of modifications or terminations of services allowing sufficient time for response to the impending termination of service.
9. Changes to these terms and conditions
geOps may customize these conditions occasionally i.e. to implement legal or regulatory requirements or to consider functional changes in the services. You should regularly review the terms of use. If you do not agree with the amended terms, you may stop using the services.
10. Caveat emptor
geOps does not guarantee the availability of services nor applicability of services for the purposes pursued by you nor does it guarantee the correctness and completeness of the displayed content.
11. Limitation of liability
Both your liability and the liability of geOps for intent, gross negligence and product liability is governed by the law. In cases of simple negligence, both you and geOps are liable only for the violation of cardinal obligations. In these cases, liability is limited to the typical use of the services at the time of foreseeable damages.
12. General legal provisions
If there is any contradiction between these terms and any additional terms and conditions or other regulations that apply to certain services, these terms apply.
The laws of the Federal Republic of Germany apply to the interpretation of these terms and conditions.
